Where and when can the representatives of the TCK deliver summons?

Military recruitment office employees may visit a conscript at their workplace.

Employees of the TCC and SP have the authority to check citizens' documents in public places and on the streets. This also applies to the delivery of summons.

Lawyer Anastasia Grigorieva spoke to News.LIVE about whether representatives of the military recruitment office can enter the premises of closed residential complexes. According to her, employees of the territorial recruitment centers have been granted expanded powers to carry out mobilization tasks.

"Mobilization legislation has been changing so rapidly lately that keeping up with it is quite a challenge. However, there is a clear trend towards establishing increasingly strict frameworks for those liable for military service during their mobilization, as well as expanding the powers of TCC and SP employees, particularly regarding the timing and locations for delivering summons," the lawyer explained.

The legislation does not specify where exactly TCC employees can deliver summonses and where they cannot. Thus, summonses can be delivered to reservists and those liable for military service around the clock:

  • at the place of residence,
  • registered/declared place of residence;
  • at the workplace;
  • at the educational institution;
  • in public places,
  • in public buildings and structures,
  • at places of mass gatherings;
  • at the military recruitment office;
  • at checkpoints (roadblocks);
  • at border crossing points with Ukraine.

Regarding the address where a person liable for military service resides, TCC representatives can either personally deliver the summons or send it via communication means.

"Now, authorized representatives of TCC and SP can check military registration documents of male citizens aged 18 to 60 and deliver summons even at night, both at their place of residence or registration and in any public place. This means that TCC and SP representatives and police have the right to enter the territory of a closed residential complex, where apartment buildings or other settlements are located, to deliver summonses and check military registration documents," the lawyer noted.

We remind you that military recruitment office employees have the right to deliver summonses for clarifying registration data, undergoing medical examinations, and mobilization. Summonses can be delivered at the place of residence, work, or by signature. If a person liable for military service refuses to sign, this is recorded as a refusal.

However, some actions by military recruitment office employees may exceed their legal authority. TCC employees are not allowed to:

  • detain or forcibly deliver individuals liable for military service. Forcible delivery is only possible by court order and with the involvement of law enforcement;
  • violate the procedure for medical examinations. The call for a medical commission must be made in a strictly established manner. If TCC coerces individuals with legitimate deferments or those deemed unfit to undergo the military medical commission, this is considered a violation of the law;
  • conduct unauthorized checks or enter the residence of a person liable for military service without permission, as well as pressure or coerce individuals into mobilization if they have a legitimate right to deferment.
