VVK in February: Who needs to undergo a repeat medical examination and what happens to those deemed "limited fitness"?

In February, citizens subject to military service, who have a deferment or previously held the status of "limited fitness," are required to undergo a repeated military medical commission (MMC). Failure to comply with this obligation may result in penalties.

However, these new regulations do not apply to all categories of Ukrainians. To avoid misunderstandings with representatives of the TCC and SP and to learn more about the new rules, explained lawyer Alexey Shalaru in a comment to Novosti.LIVE.

MMC with Deferment from Mobilization

In February, most citizens will have to renew their deferment from mobilization. However, certain categories of those subject to military service are exempt from the obligation to undergo a repeated MMC. For instance, parents of many children will automatically receive an extension of their deferment without additional checks. This is stipulated by a resolution of the Cabinet of Ministers of Ukraine.

"According to the Cabinet's resolution, this will be done automatically, and there is no need to undergo an MMC. Indeed, if during wartime the military medical commission gives a ruling once a year, it needs to be done again. This is indisputable", explains the lawyer.

Repeated Medical Examination for Previously "Limited Fitness"

Last year, the status of "limited fitness" was abolished. Now, all citizens who previously held this status must undergo a medical commission to determine their fitness for service definitively. If deemed fit, they may be assigned to rear units or to service in the TCC and SP, where physical training is not critical.

"The deadline for undergoing the mandatory MMC is now expiring. That is, there are no longer limited fitness categories—only those fit for service in rear units. Therefore, it is necessary to voluntarily update your data now, rather than waiting until a military service member is stopped on the street. Because there will be other penalties, and fines will be imposed immediately", emphasizes Alexey Shalaru.

The lawyer advises reviewing Order No. 402 of the Verkhovna Rada of Ukraine, which contains the updated list of diseases that determine fitness for service. It also includes information on who is required to undergo a repeated MMC.

"I had a situation where my diagnosis was limited, but now I have become fit for service in the TCC and SP. And many others may face the possibility of being mobilized into the army. Therefore, I recommend reviewing this order", shares the lawyer.

Recall that Law No. 3621-IX, which came into effect on May 4, 2024, abolished the status of "limited fitness" and established new criteria for assessing fitness for military service. The document also set a 9-month deadline for those subject to military service to undergo a repeated medical examination, if applicable. This means that "limited fitness" men must undergo the MMC by February 5, 2025.

Earlier, "Telegraph" reported that electronic referrals for MMCs would be introduced in Ukraine. By January 2025, a new feature will be available in the mobile application "Reserve+".
