Airborne homes. A company with a questionable reputation has set its sights on the capital's land.

At a single address, a private company registered several non-existent buildings.

Based on fictitious documents, the company involved in a criminal case regarding illegal activities related to gambling may claim land in the Shevchenkivskyi district of the capital. Public representatives have drawn attention to the questionable story surrounding the registration of non-existent structures.

"Telegraf" has learned which plot is in question and whether there is a risk that it will be transferred to the property owner through the classic "toilet scheme."

Instead of one non-residential building, several were "drawn"

The territory at the center of the latest scandal is located in the Shevchenkivskyi district of Kyiv at 2-A Daniil Shcherbakovskyi Street (Shcherbakova). Nearby is the "Nivky" metro station, and right next to it is Syrets Lake. "Previously, there were regular kiosks, umbrellas, canopies… Now there is just a concrete platform right above the lake, which remains from the dismantled structures: the lake's shore is collapsing, the area is poorly maintained, it is hazardous for pedestrians, and utility services seem to be unresponsive, with no orders issued," described the actual situation on the site by the chairman of the public council at Kyiv City State Administration Hennadiy Kryvosheya.

However, according to the State Register of Property Rights, there is a "completed construction object" at this address with a total area of 389.6 square meters. The description states that it refers to seven non-residential houses of varying sizes, the ownership of which was registered on March 9, 2024, to LLC "Nivky Stroy." On March 27 of the same year, the company sold part of these properties, covering an area of 148.3 square meters, to "LLC Nivky Budtrade."

According to the OpenDataBot service, LLC "Nivky Stroy" was registered in September 2019, with a charter capital of 9.1 million hryvnias. The owners are listed as four individuals: Andriy Posokhov, Roman Blyumin (who is also the company's director), Dmytro Vereshchynskyi, and Volodymyr Vidomenko. The first three hold a 30% share, while the last one has 10%. The main activity listed is "leasing and operating owned or rented real estate." The company has no employees, and in the "financial indicators" section, at least for 2023, there is a dash.

There are no public mentions of "Nivky Stroy's" activity in its specialization, but there is a court ruling from the Pechersk District Court of Kyiv dated December 2, 2022. It speaks of a criminal case opened "on the fact of illegal organization and operation of establishments to provide access to gambling." It is evident that this structure had "protection" among law enforcement, as it is noted that there were recorded "instances of illicit gain received by employees of the National Police of Ukraine for not taking the measures prescribed by law and hiding the illegal activities related to organizing or conducting gambling."

Moreover, such illegal businesses existed not only in Kyiv but also in Odesa and Zaporizhzhia. In the capital, a "non-residential premises (without specifying the address – Ed.) was adapted for it, which is partly owned by LLC "Nivky Stroy." Consequently, the State Bureau of Investigation received permission to conduct a search at this facility, but whether it was able to gather the necessary evidence and how the case concluded remains unknown.

LLC "Nivky Budtrade" has the same registration address as "Nivky Stroy" — 2-A Daniil Shcherbakovskyi Street. According to OpenDataBot data, the company was registered only on January 18, 2024 – that is, two months before acquiring part of the fictitious non-residential buildings. Among the founders are Volodymyr Vidomenko (who is also a co-owner of "Nivky Stroy") and Viktor Kalyuzhny, who serves as director. The company's charter capital is 1 million hryvnias, but there are no mentions of financial activity in open sources.

Hennadiy Kryvosheya suspects that the fictitious documents for registering non-existent property represent yet another "toilet scheme" that will allow the two companies to claim the land.

The plot has not been formed or registered

To clarify the situation surrounding the territory at Nivky, "Telegraf" submitted a request to the Kyiv City State Administration. Here’s what the officials responded. First, back in late 2019, LLC "Nivky Stroy" registered in the electronic cabinet in the field of urban planning "a notification of the commencement of construction works, which, based on the class of consequences (responsibility), pertains to objects with minor consequences (SSI) 'Reconstruction of a non-residential building at Daniil Shcherbakovskyi Street, 2-A, letter I.' Its area, according to the State Register, is 161.5 square meters. And it appears this is the only real building that exists at this address, at least according to the search results, it shows a confectionery store on the map. The Department of State Architectural and Construction Control of the KCSA noted that no documents from "Nivky Stroy" were received, as registration in the electronic cabinet occurred automatically and grants the right to perform preparatory and construction works. However, whether these works were actually carried out is unknown.

Secondly, as of February 2025, the Urban Planning and Architecture Department did not provide either LLC "Nivky Stroy" or LLC "Nivky Budtrade" with urban planning conditions and restrictions for designing the construction object at 2-A Daniil Shcherbakovskyi Street. Additionally, the Department of Territorial Control of the city of Kyiv did not issue control cards to these two companies for violations of landscaping and its restoration (this is a document that only records the fact of conducting construction, repair, and other works but does not grant permission for them – Ed.)

Thirdly, the land plot at this address is also in an undefined status. The Department of Land Resources of KCSA reported: the petition for permission to develop a land management project for a shopping complex was submitted back in 2004 by the private enterprise "Industrial and Commercial Firm 'KEYT'" (currently in liquidation status). It was granted for an area of 0.104 hectares. "Based on the Department's submission, the Kyiv City Council has not made any decisions regarding the transfer of the land plot at 2-A Shcherbakovskyi Street in the Shevchenkivskyi district of Kyiv into ownership or use (lease) by any legal or physical persons. Information on the formation and registration of the requested land plot in the State Land Cadastre is absent in the Department," the Land Resources Department stated.

Thus, it seems that either due to public attention or other reasons, the company that registered the property at Nivky has not yet taken steps to seize the land.

Then another logical question arises: do city authorities plan to restore order in the territory that currently has no other owner besides the community? After all, temporary structures were removed last autumn, and there were promises to hold auctions for the right to trade in kiosks set up where they would not obstruct pedestrian movement, as well as to establish green zones, repair pathways, and improve access to public transport stops. At least, this was reported by media outlets citing the director of the Department of Territorial Control of the city of Kyiv, Mykhailo Budilov .

The decision to relocate kiosks in this area (specifically at the addresses 86-88/2 Beresteyskaya Street, and 1 and 2 Daniil Shcherbakovskyi Street) was made to remove "obstacles in the path of evacuation and passenger movement to the 'Nivky' metro station." This was insisted upon by the Kyiv Defense Council since mid-2022, but the relevant commission only reviewed it in October 2024 and implemented it a month later. A total of 44 temporary structures were dismantled, covering an area of 755.02 square meters, and officials proposed a scheme for their relocation, which was submitted for consideration to the Department of Urban Planning and Architecture of the KCSA.

In turn, the Department of Territorial Control of the city of Kyiv inspected the area near the "Nivky" metro station and issued orders to rectify violations of the Landscaping Rules. This falls under the responsibility of two municipal enterprises, which were supposed to tidy up the sidewalk and ensure landscaping. However, the deadlines for completing such works are unknown to the state administration's division.
