Who won't receive a deferment from mobilization in January?

Some fathers of large families may be subject to mobilization.

During the general mobilization, certain categories of Ukrainians are entitled to a deferment from conscription. However, this right is not automatic and may be lost under specific conditions.

"Telegraph" explains who will not receive a deferment in January 2025. According to Ukrainian legislation, deferment is not granted for the following reasons:

  • part-time student, evening student, or pursuing a second higher education, etc.;
  • father of multiple children and has outstanding child support payments;
  • caring for a spouse with a 3rd group disability (there are some exceptions here);
  • caring for individuals with 1st and 2nd group disabilities, but there are other relatives who can also provide care;
  • single father, but the child's (children's) mother has not been deprived of parental rights, is not declared deceased/missing, and is not incarcerated;
  • employed by an enterprise, organization, or institution of the Ministry of Defense of Ukraine and does not have a reservation.

A man who was previously deemed unfit for military service by a military medical commission (MMC) but is recognized as fit after a subsequent medical examination may also be mobilized.

When can a deferment be canceled

The right to deferment can only be annulled in two cases:

  • Providing false information. If a conscript submits fake documents or provides inaccurate information, the deferment decision will be revoked.
  • Loss of grounds for deferment. For instance, if a person stops caring for a relative with a disability or their health condition changes, affecting their right to deferment.

Lawyers explain that deferment is a legal right of citizens and the Territorial Center for Recruitment (TCR) cannot deny or revoke it without legal grounds. In cases of rights violations, citizens can challenge the decisions of military commissions either administratively or through the courts.

If the TCR attempts to revoke a deferment without justification, one should appeal to higher authorities or seek legal assistance. The legality of the deferment can be proven in court by providing the necessary documents and evidence.
