The mobilization continues in Ukraine, and summons to the Territorial Centers for Recruitment and Social Support (TCRC) are mandatory. However, if a citizen was hospitalized or had another valid reason, they may not appear at the recruitment office by the specified deadline.
Yet, the mere fact is not enough; it is necessary to officially notify the TCRC. Lawyer Dmitry Kushnarenko commented to RBC-Ukraine that such notification should be sent by registered mail via "Ukrposhta" with a description of the enclosed documents.
"This will also allow for appealing against fines that may be imposed. Or contest other processes related to administrative liability. For instance, freezing of accounts and possibly the sale of property or revocation of driving rights, etc.", — explains the lawyer.
To contest a fine, it is necessary to obtain a copy of the administrative offense ruling. If the summons was delivered with violations (for example, not signed personally or improperly executed), it is advisable to obtain such a document with the involvement of a lawyer at the TCRC.
The main grounds for contesting are often procedural violations that may have occurred during the delivery of the summons or the issuance of the ruling.
"Therefore, it is important to carefully analyze every aspect – the text of the summons, the method of its delivery, the content of the ruling, and compliance with procedural norms. Other circumstances, such as improper documentation or lack of signatures, may also serve as grounds for appeal.", — notes Kushnarenko.
The ruling on the administrative offense can be contested within 10 days through the general local courts. If this period is missed, the lawyer can submit a petition for its restoration.
The lawyer explains that information about fines or other penalties can be found in the State Register of Debtors of Ukraine. For this, your taxpayer registration number (RNOCPP) is required.
Previously, "Telegraf" reported whether men who came to the TCRC to update their data could be fined. Courts do not always provide a clear answer.
